I heard Germany is revising and reissuing occupational exposure limits. What can you tell me about it?
BAuA, the federal agency responsible for workplace safety and medicine, has reissued TRGS 900. The Technical Guidelines on Dangerous Substances (TRGS) 900 provides rules for exposure to dangerous substances in the workplace, and establishes an OEL list for Germany. The reissued TRGS 900 makes significant changes to annex of substances for which occupational exposure limits have been assigned. You can read more about it here.

What are the MSDS availability requirements for crack sealant that was used previously and still exists in the cracks in the concrete at our facility but is no longer on the shelf and available for employee use?
Per the Federal OSHA Hazard Communication standard (29 CFR 1910.1200), an MSDS is required only if:
-
The sealant is a hazardous material (possesses either physical or health hazard properties) and
-
The sealant is known to be present in the workplace in such a manner that the employees may be exposed under normal conditions of use or in a foreseeable emergency (spills, leaks, exposure prevention equipment failure).
If the only sealant at your place of business is the used material within the cracks in your pavement, you as the employer must determine whether the hardened sealant in the pavement cracks still possesses any hazard properties and whether there is a potential for employee exposure to that hazard. My inclination is that no potential for hazard exposure exists, however the burden of determination rests with you as the employer.
If there was a potential for employee exposure to this material prior to present conditions, you may have an obligation to maintain a copy of the MSDS under another OSHA regulation (29 CFR 1910.1020).

Singapore establishes new workplace safety act Singapore?s Manpower Ministry announced its Factories Act will be abolished and replaced by the new Workplace Safety and Health Act, which will form the legal framework for a new occupational safety and health regulatory system. According to the ministry, the act will cover all workplaces within the next 3 to 5 years. It is expected to go into effect in late March.

OSHA's pending hexavalent chromium regulations affect general industry more than construction or shipyards. In January 2006, the new OSHA regulation on CrVI is supposed to go in effect (Occupational Exposure to Hexavalent Chromium, 29 CFR Parts 1910, 1915, 1918, and 1926). The most current version of the chromium rule was published as a Notice of Proposed Rulemaking (NPRM) in the October 4, 2004, Federal Register. The NPRM proposed three separate standards that cover exposure to CrVI in general industry, construction, and shipyards. By a court order mandate, the rule is supposed to be implemented by January 2006. Read the full story here.
